It’s definitely good to have this explanation from Matt Cutts. As I watched the video and listened to Matt, I completely agree that the vast majority of time, things are incredibly clear. People are paying money, outright, for links, based on PageRank of the site to get higher ranking of their website on the search results.
But even though Matt tried his best to explain the process that Google Spam team goes through, as you watch the video below you can see that its very hard to define issue of Paid vs Not. There are just a lot of gray areas open anyone’s interpretation. What I am saying is, trying to make this issue black and white is near impossible.
A lot of what Cutts talked about was intent and money invested to get higher ranking, but I think that’s very hard to to prove. Take a look at the questions that Google Web Spam team goes through to determine if a link if paid or not. Honestly, just looking at these questions, you will need a lawyer to interpret and explain then in layman’s term.
- What is the value of the gift, product, or service?
- How close is the gift, product, or service to actual money?
- Is it an outright gift or a loan?
- Who is the intended audience?
- Is the intent of the gift to get links?
- Would the gift be a surprise to third party?
